Town of Londonderry Right-to-Know Procedure

The Town of Londonderry is committed to openness and transparency in its governmental function, and complies with all Right-to-Know (RTK) procedures set forth by the State of New Hampshire in RSA 91-A. In order to ensure the Town is in compliance with the law at all times, and in light of the large number of requests the Town receives, the Town has chosen to develop a comprehensive RTK policy for all Town departments, committees, boards, and employees.* The Town has created a form to help requesters provide all pertinent information required for the Town to fulfill each request. All official correspondence from the Town regarding RTK requests will be in writing.

Any RTK request will be followed up on by a Town of Londonderry representative. The representative will confirm the details of your request, the anticipated time frame to fulfill the request, and your availability to come in and review any non-digitized materials found responsive to your request. If the materials you requested are readily available on the Town website, they will inform you of that as well.

When responding to an RSA 91-A request, the Town complies with the definition of government records stated in RSA 91-A:1-a:

"any information created, accepted, or obtained by, or on behalf of, any public body, or a quorum or majority thereof, or any public agency in furtherance of its official function. Without limiting the foregoing, the term ‘governmental records’ includes any written communication or other information, whether in paper, electronic, or other physical form, received by a quorum or majority of a public body in furtherance of its official function, whether at a meeting or outside a meeting of the body. The term ‘governmental records’ shall also include the term ‘public records.’"

The Town also complies with the exemptions stated in RSA 91-A:5 and those created by case law.

*Requests for the Londonderry Police Department should continue to be made through the Records Division.

Steps to Submitting a RTK Request:

  1. All Right-to-Know email requests should be filed through rtkrequest@londonderrynh.org. This is so the Town can accurately track the timing and fulfillment of each request in order to ensure full compliance with 91-A. Any requests sent directly to departments will be forwarded to this email. Alternatively, requests can be mailed or dropped off in person to:

  1. The Town provides a Right-to-Know request form to be filled out. State law does not require a written request; however, written requests assure all parties have a verifiable copy of the request, and there is no ambiguity as to what is being requested. If you choose not to fill out this form, a staff member will do so on your behalf.
  2. If the Town is not able to make a governmental record available for immediate inspection, the Town will, within 5 business days of your request, make the such record available, deny the request in writing with reasons, or furnish a written acknowledgment of the receipt of the request and a statement of the time reasonably necessary to determine whether the request shall be granted or denied.
  3. Once filled, a representative of the Town will contact you to supply the documents found responsive to your request. Digital responsive documents will be provided through a Dropbox link. For physical records, a staff member will contact you to set up an appointment to review the documents found responsive to your request.
    1. If, after reviewing the physical documents found responsive to your request, you wish to obtain copies, you may request photocopies at a charge of $.50 for the first 10 pages of a document, and $.10 per page for each page of that document thereafter.
    2. All charges must be paid in the Town Clerk's office before documents will be delivered.
